Please read these Terms & Conditions carefully before using the Southern Solar Monitoring service.

1. Acceptance of Terms

These Terms & Conditions (the "Terms") govern your access to and use of the Southern Solar Monitoring service, including any web applications, dashboards, mobile interfaces, reports, alerts, communications, and related services (collectively, the "Service") provided by Southern Solar Monitoring ("Southern Solar Monitoring", "we", "us", or "our").

By accessing or using the Service, creating an account, or clicking to accept or agree to these Terms where that option is made available, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

If you are accessing or using the Service on behalf of a company, organization, or other legal entity (a "Customer"), you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" will refer to that entity. If you do not have such authority, you must not accept these Terms or use the Service on behalf of such entity.

2. Description of Service

Southern Solar Monitoring is a solar monitoring and insight platform that provides visibility into the performance and status of solar photovoltaic (PV) systems. The Service is designed to help system owners and operators monitor key parameters, identify potential issues, and make more informed decisions regarding solar system performance and maintenance.

Depending on your subscription plan and configuration, the Service may include, without limitation:

  • Solar production and performance visibility via web or mobile dashboard;
  • Automated alerts and notifications regarding certain performance conditions or data anomalies;
  • AI-generated solar health, performance, or trend reports based on available data;
  • Access to historical performance data and basic analytics (subject to data availability);
  • Customer support and issue reporting channels;
  • Optional coordination of technician, installer, or on-site services through us or third-party providers, where available and as included in your plan.

The Service is informational in nature and is not a replacement for on-site inspection, professional electrical work, or any legally required monitoring or safety systems. Southern Solar Monitoring does not guarantee any specific level of energy production, savings, or system uptime.

3. Eligibility

You may use the Service only if you:

  • Are at least 18 years of age (or the age of majority in your jurisdiction);
  • Have full power and authority to enter into these Terms;
  • Provide accurate, current, and complete registration and account information;
  • Maintain and promptly update your account information as needed to keep it accurate and current;
  • Have the necessary rights or permission to authorize Southern Solar Monitoring to access and monitor the solar system and associated data sources (such as inverter portals or monitoring gateways).

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify Southern Solar Monitoring immediately of any unauthorized access to or use of your account or any other breach of security. Southern Solar Monitoring reserves the right to refuse, suspend, or terminate access to the Service to any individual or entity at our reasonable discretion, including for violation of these Terms or applicable law.

4. System Connectivity & Data Access

In order to provide the Service, Southern Solar Monitoring may require access to data generated by your solar PV system and related devices and services, which may include inverters, optimizers, meters, gateways, data loggers, utility interfaces, or third-party monitoring portals (collectively, "System Data Sources"). You authorize Southern Solar Monitoring to access, collect, store, process, and use data from these System Data Sources as reasonably necessary to operate and improve the Service, subject to our Privacy Policy.

Such access may be established by, for example, connecting to third-party application programming interfaces (APIs), using login credentials or tokens you provide, or connecting to site hardware or data loggers. You represent and warrant that you have all necessary rights and permissions to grant Southern Solar Monitoring access to System Data Sources and to authorize our use of the associated data as described in these Terms and our Privacy Policy.

You acknowledge that the accuracy, completeness, and timeliness of the Service is dependent on the availability and quality of data from System Data Sources and network connectivity. Southern Solar Monitoring is not responsible for any interruption, delay, inaccuracy, or loss of data caused by:

  • Hardware failures, misconfiguration, or network connectivity issues at your site;
  • Third-party platform outages, API changes, credential issues, or data errors;
  • Incorrect or incomplete system details provided by you or your installer;
  • Physical changes to the system (e.g., added/removal of equipment) not communicated to Southern Solar Monitoring;

You are responsible for maintaining any required internet connection, local network, and hardware functionality necessary for the Service to receive and process data from your solar system.

5. Monitoring & Alerts Disclaimer

Southern Solar Monitoring may provide automated alerts, notifications, or flags based on system data, thresholds, or anomaly detection logic. These alerts are intended as informational prompts to help you identify potential performance issues or unusual conditions. You acknowledge and agree that:

  • The Service does not provide emergency or safety monitoring and must not be relied upon for any life-safety or critical protection function;
  • Alerts may be delayed, not delivered, or missed due to connectivity issues, third-party outages, data gaps, or configuration errors;
  • Not all system faults or performance issues will be detected or alerted on by the Service;
  • You remain solely responsible for regularly reviewing your system’s performance, complying with manufacturer and installer recommendations, and arranging for timely maintenance or repair as needed.

Any recommendations or suggestions communicated through alerts, dashboards, or reports are provided for informational purposes only and do not constitute professional, engineering, or financial advice. You should consult qualified professionals before making decisions about system maintenance, modifications, or financial matters related to your solar installation.

6. AI Reports Disclaimer

Southern Solar Monitoring may provide AI-generated reports, summaries, or insights related to the health, performance, or trends of your solar system ("AI Reports"). AI Reports are generated using automated data processing and machine learning models based on available data sources and configuration at the time of generation. You acknowledge and agree that:

  • AI Reports may contain inaccuracies, omissions, or misinterpretations due to limited, noisy, or incorrect data;
  • AI Reports do not constitute professional engineering, electrical, financial, or legal advice;
  • You should not rely on AI Reports as the sole basis for making safety, maintenance, or financial decisions about your system;
  • Southern Solar Monitoring does not guarantee any future performance, savings, or return on investment based on AI Reports or related projections.

You remain solely responsible for validating any significant conclusions drawn from AI Reports and for seeking advice from qualified professionals where appropriate. Southern Solar Monitoring disclaims any liability arising from decisions you make based on AI Reports, to the maximum extent permitted by law.

7. Support & Technician Services

Southern Solar Monitoring provides customer support for questions related to the use of the Service, configuration of monitoring, and interpretation of high-level performance indicators. Support channels and response times may vary depending on your subscription plan and region, and are subject to reasonable volume and availability limits. While we strive to be helpful, support interactions do not constitute professional engineering or electrical services.

Certain subscription plans may include or provide access to optional technician visits, on-site inspections, or other field services ("Technician Services"). Technician Services may be provided by Southern Solar Monitoring personnel or by independent third-party contractors, installers, or service companies (collectively, "Technicians"). Unless expressly agreed otherwise in a separate written agreement:

  • Technician Services are subject to scheduling, geographic availability, and separate fees or charges, even if coordinated via the Service;
  • Technicians are responsible for the quality and safety of their own work and must carry any licenses, insurance, and permits required by applicable law;
  • Any repair, replacement, or upgrade work performed by Technicians is governed by your separate agreement with them, and Southern Solar Monitoring is not a party to or responsible for that work unless explicitly stated in writing;
  • Southern Solar Monitoring’s role may be limited to facilitating introductions, sharing diagnostic information, or coordinating visits as a convenience to you.

Southern Solar Monitoring is not responsible for property damage, personal injury, code violations, or warranty impacts arising from Technician Services performed by third parties, to the fullest extent permitted by law. You are responsible for verifying the credentials of any Technician you choose to engage and for ensuring that any on-site work is carried out safely and in compliance with applicable regulations and manufacturer guidelines.

8. Subscriptions, Billing & Payments

Access to the Service is typically offered on a subscription basis (the "Subscription"), which may be billed monthly, annually, or on another recurring basis, as specified at the time of purchase or enrollment. By starting a Subscription, you authorize Southern Solar Monitoring or its third-party payment processors to charge your designated payment method for all applicable fees, taxes, and any add-on services selected by you, in accordance with the billing terms presented to you at signup or in subsequent plan changes.

Unless expressly stated otherwise, Subscriptions will renew automatically at the end of each billing period for the same term and at the then-current rates. You may prevent renewal by canceling your Subscription in accordance with Section 9 (Cancellation) before the end of the current billing period. You are responsible for all Subscription fees incurred until cancellation is effective.

Southern Solar Monitoring may change Subscription fees and billing terms from time to time, with such changes becoming effective at the start of the next billing cycle after notice is provided to you (for example, by email or in-app notification). Your continued use of the Service after the effective date of any fee change constitutes your acceptance of the updated fees.

Except where prohibited by law or as expressly stated in a written agreement with you, all payments are non-refundable and non-creditable, including for partial periods of service, unused features, or downgrades. You are responsible for any bank fees, currency conversion charges, or other charges imposed by your payment provider in connection with your payments for the Service.

9. Cancellation

You may cancel your Subscription at any time by following the cancellation instructions within your account settings or by contacting Southern Solar Monitoring using the contact information in Section 16. Cancellation will take effect at the end of your current billing period, unless otherwise stated in writing. You will continue to have access to the Service until the cancellation effective date, and you will not receive a refund or credit for any unused days in your billing period, except where required by applicable law or as expressly stated by Southern Solar Monitoring in a written commitment to you.

Southern Solar Monitoring may suspend or terminate your access to the Service, in whole or in part, at any time and with or without notice, if we reasonably believe that you have violated these Terms, failed to pay fees when due, misused the Service, or engaged in fraudulent or unlawful activity. We may also discontinue or materially modify the Service, or any portion thereof, by providing reasonable advance notice where practicable. In the event of a termination by us without cause and not due to your breach, we may, at our discretion, provide a prorated refund of prepaid fees for the remaining unused period of your current billing term.

10. Installer Relationships & Partner Programs

Southern Solar Monitoring may make the Service available through or in collaboration with solar installers, equipment manufacturers, financing providers, or other partners (collectively, "Partners"). In some cases, your Subscription may be bundled with installation, financing, or service packages arranged by a Partner. Unless Southern Solar Monitoring is expressly identified as a party to your agreement with a Partner, that Partner is solely responsible for its own products, services, and claims, and Southern Solar Monitoring is not liable for any obligations or representations made by such Partner.

If your access to the Service is arranged or paid for by a Partner, Southern Solar Monitoring may follow the Partner’s instructions regarding activation, suspension, or termination of your access, to the extent consistent with applicable law and any separate agreements. Disputes related to installation quality, system performance warranties, or financing terms should be directed to the relevant Partner, not to Southern Solar Monitoring, unless we have expressly assumed such responsibilities in a separate written agreement with you.

11. Intellectual Property

The Service, including all software, dashboards, interfaces, visuals, algorithms, AI models, documentation, and other materials provided by Southern Solar Monitoring (collectively, "Southern Solar Monitoring Materials"), are protected by copyright, trademark, and other intellectual property laws. Except for the limited rights expressly granted in these Terms, Southern Solar Monitoring and its licensors retain all right, title, and interest in and to the Southern Solar Monitoring Materials and the Service, including all associated intellectual property rights.

Subject to your compliance with these Terms and payment of all applicable fees, Southern Solar Monitoring grants you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Service during your active Subscription, solely for monitoring and managing the solar system(s) associated with your account and for your internal purposes. You may not, and you agree not to permit any third party to:

  • Copy, modify, adapt, translate, or create derivative works of the Service or Southern Solar Monitoring Materials;
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software forming part of the Service, except to the extent this restriction is prohibited by applicable law;
  • Rent, lease, sell, sublicense, distribute, or otherwise transfer rights to the Service to any third party;
  • Circumvent or attempt to circumvent any access controls, usage limits, or security features of the Service;
  • Remove, obscure, or alter any proprietary notices or branding on or in the Service.

You retain ownership of any data you provide to Southern Solar Monitoring or that is collected from your System Data Sources and associated with your account ("Customer Data"). You grant Southern Solar Monitoring a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, display, and use Customer Data as necessary to provide, maintain, secure, and improve the Service, and as otherwise described in our Privacy Policy. Southern Solar Monitoring may also use aggregated and/or de-identified data derived from Customer Data for analytics, benchmarking, and service improvement, provided that such data does not identify you or your specific site(s).

12. Privacy & Data Protection

Southern Solar Monitoring’s collection, use, disclosure, and protection of personal information and certain system-related data are governed by our separate Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have reviewed and agree to the practices described in our Privacy Policy, as updated from time to time. The current version of the Privacy Policy is available via the Service or on our website at the link designated for "Privacy Policy" (or a similarly titled page).

You are responsible for ensuring that you have all necessary rights and consents to provide Customer Data to Southern Solar Monitoring and to permit our processing of such data as described in these Terms and the Privacy Policy. If you provide us with personal information about third parties (such as additional system owners or authorized users), you represent that you have obtained any necessary permissions or notices required by applicable data protection laws before providing such information to us.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SOUTHERN SOLAR MONITORING, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE).

WITHOUT LIMITING THE FOREGOING, SOUTHERN SOLAR MONITORING WILL NOT BE LIABLE FOR DAMAGES OR LOSSES RESULTING FROM (A) HARDWARE FAILURES OR INSTALLATION DEFECTS; (B) THIRD-PARTY PLATFORM OUTAGES OR DATA ERRORS; (C) YOUR RELIANCE ON ALERTS, AI REPORTS, OR OTHER INFORMATION FROM THE SERVICE WITHOUT APPROPRIATE PROFESSIONAL VERIFICATION; (D) UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT OR DATA ARISING FROM YOUR FAILURE TO SAFEGUARD YOUR CREDENTIALS; OR (E) ANY ACTIONS OR OMISSIONS OF THIRD-PARTY TECHNICIANS, INSTALLERS, OR PARTNERS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF SOUTHERN SOLAR MONITORING AND ITS AFFILIATES FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO SOUTHERN SOLAR MONITORING FOR THE SERVICE DURING THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF LIABILITY FOR CERTAIN TYPES OF DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, THE LIABILITY OF SOUTHERN SOLAR MONITORING WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

14. Service Availability & Disclaimers

Southern Solar Monitoring aims to provide a reliable and continuously available Service, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. The Service may be temporarily unavailable for maintenance, upgrades, or due to technical issues, outages of third-party service providers, or events beyond our reasonable control (such as acts of God, natural disasters, labor disputes, or network failures). We will make reasonable efforts to minimize disruption and, where practicable, to provide notice of scheduled maintenance that may materially affect availability.

EXCEPT AS EXPRESSLY PROVIDED IN A SEPARATE WRITTEN AGREEMENT SIGNED BY SOUTHERN SOLAR MONITORING, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOUTHERN SOLAR MONITORING DOES NOT WARRANT THAT THE SERVICE WILL ACCURATELY DETECT ALL SYSTEM ISSUES, PREVENT FAILURES, OR ACHIEVE ANY PARTICULAR ENERGY OUTPUT, SAVINGS, OR FINANCIAL RESULT.

15. Changes to Terms

Southern Solar Monitoring may update or modify these Terms from time to time, for example to reflect changes in the Service, legal requirements, or business practices. When we make material changes, we will provide notice through the Service, by email, or by other reasonable means. The "Last updated" date at the top of these Terms will indicate when changes were most recently made. Unless otherwise specified, updated Terms will become effective upon posting.

By continuing to access or use the Service after updated Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your Subscription in accordance with Section 9. Any changes to the dispute resolution provisions will not apply to disputes for which the parties have actual notice on or before the date the changes are posted.
